Brand Agreement

This agreement applies when you book Creators as a Brand on Marquee. It works alongside our Terms of Service.
1. Booking and the service fee
You book Creators at their listed rate plus a flat 15% service fee, shown before you pay. The fee covers payment processing, escrow-style fund handling, dispute support, and the Platform.
2. Payment and fund holding
You pay up front at booking. Marquee holds the funds and releases them to the Creator only after you approve the deliverable — or after the review window closes and the work auto-approves. Marquee holds funds as a convenience and is not a bank or licensed escrow agent.
3. Review window and approval
When a Creator submits work, you have a defined review window to approve it or request a revision per the listing's revision policy. If you take no action within the window, the deliverable auto-approves and payout is released. Approving — or letting work auto-approve — confirms the Creator met the brief.
4. Refunds, disputes, and chargebacks
If something goes wrong, open a dispute and we'll help resolve it; we may release or refund held funds based on the evidence and the approval record. Initiating a card chargeback after you've approved work (or after auto-approval) is a breach of this agreement, and your in-Platform approval may be submitted as evidence. The service fee is generally non-refundable once work has been delivered.
5. Usage rights
You receive the usage rights selected on the booking (organic only, paid amplification, whitelisting, etc.). Using a deliverable beyond those rights requires a new agreement with the Creator.
6. Your responsibilities
Provide a clear brief and any assets the Creator needs, respond within the review window, and comply with advertising laws and disclosure rules. Don't ask Creators to publish misleading claims or undisclosed ads.
7. No circumvention
Keep bookings and payments on Marquee. Moving a relationship first formed here off-platform to avoid fees removes the protections (escrow, dispute resolution) and may result in account removal.
